1. Definitions    

1.1   Moodle - an open source e-learning web application at https://moodle.edu.ee

1.2   Product owner  – Ministry of Education and Research (hereinafter Owner), who provides the opportunity to use the Moodle learning environment.

1.3   User - any natural person who has created a user account (hereinafter Account) in the Moodle environment.

1.4   Organisation - an educational institution that conducts educational activities in the learning environment.

2. General

2.1   The Users and Organisations can use Moodle only when accepting all Terms of Use (hereinafter Terms). If Terms are not accepted, the Account is not created for the User and the Organisation is not allowed to use the Service.

2.2   The use of the product is understood as all activities that are necessary (a) for the Institution to organize educational activities and (b) for the User to participate in educational activities.

2.3   Use of the Service is possible only via the personal and identifiable Account. To use the Service, it is possible to authenticate the User with the user name and password, ID card, Mobile ID and TAAT authentication solution.

2.4   Creation of the Account is free for the User. The Organisation must pay for the use of the Service except for an Organisation whose use of the Service is financed by the Ministry of Education and Research.

3. How to create and delete the Moodle account

3.1   To create the Moodle Account, the person must be at least 13 years old or use the Service based on the document that regulates the study arrangements or have the consent of a legal representative for creating the User account.

3.2   To create the Account, it is necessary to enter to Moodle the first name and surname, e-mail and personal password that contains at least 6 symbols with one lowercase letter and one number.

3.3   Upon first logon, the User must add their own personal identification code to the Account that allows reliable identification of the User and further logons via ID card/Mobile ID. If the user creates an account with someone else's personal code and the Owner can identify it, the account with the wrong personal identification code will be deleted without warning.

3.4   In the absence of the Estonian personal identification code, it is possible to apply for personal identification code excemption by filling in the relevant cell in the Moodle’s personal data form. Product client helpdesk will review the personal identification code excemption and accept or reject it within one business day.

3.5   The Owner has the right to delete the Account if the User has not done anything in the Product during the last 4 years. After deleting the Account, it is not possible to use the Product, if necessary, the User can create a new Account

4. User’s rights, obligations and liabilities

4.1   The User can participate in the studies carried out in Product or carry out studies in Product only when the Organisation has created a relevant link with the User (added the role), or as a guest in public e-courses if such permission is granted by the creator of the course.

4.2   When the Account is created, a private area appears for the User in Moodle where the User can add personal information in addition to the data necessary for creating the Account. The User can change and delete the added personal information at any time. It is not possible to delete data in mandatory fields.

4.3   The User is responsible for the accuracy of the personal data added to the Account and interfacing Moodle with external services and involved data exchange.

4.4   Upon the use of the Account, the User will take every effort to prevent any third party access to the Account.

4.5  In the event of a possible risk, the User has to take measures to avoid any third party access to the Account (e.g. changing the password, stopping the ID card or Mobile ID, and other). It is also necessary to inform user support of the Service in case of an occurred risk via e-mail moodle@tugi.edu.ee

4.6   Any activities that may prevent the Owner from providing the Service or are contradicting the legislation, are forbidden upon creating the Account and using the Service. Upon detection of the forbidden activities, the Owner has the right to restrict the User’s access to the Service.

4.8   The User can interface their Account with services outside Moodle (e.g. Google Drive). Harno will not control interfacing of the Account with external services. Harno can only see the fact of interfacing with the external service.

4.9   When signing up as a User, the User agrees to receive Service-related messages.

5. Organisation’s rights, obligations and liability

5.1   The Organisation has the right to use the Service for conducting educational activities. Each Organisation gets their own sub-category in Moodle.

5.2   All Organisations can use the Service as is i.e. it is maintained by Harno according to the source code available from moodle.org.

5.6   The Organisation can interface its Moodle sub-category with external services (e.g. Google Drive, Echo360, and other). Interfacing of the Organisation’s sub-category with external services and the data exchange resulting from it is not controlled by Harno, and in respect of that the Organisation is fully responsible for the interfacing and notification of the Users in case of transferring personal data.

5.7   The Organisation will ensure the compliance of the materials added to and created in the Moodle environment with the law, including consistency with copyrights.

5.8  The Organisation undertakes to remove the Users from the Moodle studies (e-courses) within 6 months after the end of the course..

5.9  The Organisation is responsible in case of damage caused by assigning roles, including violation of the data protection requirements and activities damaging the functioning of the Service.

5.10  The Organisation announces large-scale events (Olympiads, entrance exams, etc.) at least 2 weeks before the event. If this has not been done, the Owner does not guarantee that the customer support service will be provided to the required extent and quickly enough.

6. Rights, obligations and liability of HTM

6.1  Harno has the right to make unilateral amendments in the Terms by notifying the Users and Organisations about it on the Harno web page and/or via emails indicated in Moodle.

6.2   The Owner provides an opportunity to use the Moodle learning environment for the Organisations and the Users an opportunity to create an Account in the Moodle learning environment to participate in the educational activities conducted by the Organisations in Moodle. The Service is provided 24/7, except during maintenance times notified by the Owner.

6.3   The product is managed and hosted by the Owner on servers located in the territory of Estonia. The Owner maintains the software of the product, servers and database, adding up-to-date security updates is part of the work. Products are updated on the last Thursday evening of every month at 16:00 - 20:00.

6.4  Maintenance windows are used for performing maintenance. For more information see https://moodle.edu.ee. The use of the Service is suppressed or limited during the maintenance.

6.5   Backups created by users are kept for 6 months, backups older than 6 months are deleted.

6.6   The Owner provides use-related support for the Users and Organisations. Support is provided via e-mail moodle@tugi.edu.ee

6.7   The Owner is not responsible for any entered data or materials uploaded to Moodle by the Organisations and Users.

6.8  The Owner is not responsible for the failures of the Service caused by circumstances that are outside the control of Harno.

6.9 The owner has no obligation to restore the course, unless it has been lost for technical reasons. Materials deleted by users will not be restored.

7. Personal data protection

7.1   The Owner processes entered personal data only to allow the Users to create the Account and ensure the Organisation to provide the Service to the necessary extent.

7.2  For more effective provision of the Service, the Service will use cookies saved to the web browser that contains: the User’s IP-address, geographical location; browser type and version, operation system, reference source, page views and web site navigation paths; also information about the timing, frequency and model of use of the Service. The cookies generally do not contain data based on which the User’s identity could be identified but the personal data saved by the User may be associated with the cookies and through these, the activity of the User in the web browser could be associated with the User’s identity.

7.3   The Owner discloses personal data only to the Organisations who use the Service to allow the Organisation to assign the Organisation-related role to the User, and on other occasions if the data disclosure requirement is based on legislation.

7.4  The Organisation is responsible for compliance of processing personal data processed by the Organisation or by the Users in the Moodle environment (including data exchange involved in external services interfaced with the Service) with legislation by being the controller of this personal data.

7.5   In respect of the data indicated in clause 7.3, The Owner is the processor by enabling to use the Service for processing personal data, by providing support for the Service and by hosting personal data in Moodle in its servers.

7.6  The User must address the Organisation under whose educational activities their personal data is being processed in Moodle with issues related to processing of personal data related to the study activities, or for the exercise of statutory rights.

7.7  The User is able to see all their personal data in Moodle at any moment in Moodle in respect of their Account data. The User is required to keep their personal data up-to-date in Moodle.

7.8  To enhance the quality of the Service, Harno may process all personal data within the Service to provide the User support of the Service or to analyse the Service.

7.9   The Owner will inform all Users about possible data leaks on its web site (www.hm.ee), the home page of the Service (www.moodle.edu.ee) and via e-mails provided by Moodle within 72 hours. In addition, the Owner will inform the Information System Authority and the Data Protection Inspectorate via appropriate incident report form. The Owner will immediately take all measures to prevent the use of leaked data in any way against the Users of the service.

Since the Owner’s contact information may change in time, it is not brought out in the Terms of Use document. The Owner is a legal person in the public sector and it’s contact information is freely accessible through its public web page (www.hm.ee).
